Hi Guys,
I have ordered a Domane AL3 from trek, waited 3 months and it has been delayed for another month.
I have been researching online, and there has been stories of people having to wait over 13 months for their trek bike, after getting delayed multiple times.
I figured if its delayed again, I would just get another bike, then potentially waiting for over a year!
However I have already put a % down for a deposit, will i have to forfeit this? I was told when i deposited it would be delivered in 3 months, I cant potentially wait over 13 months like some others.
Need some advice

I recently put down deposit for Giant Defy with expected 3 month delivery timeframe. I was told it is fully refundable. They will have multiple alternate buyers so it should not be a problem.

it says on the invoice they can keep 10% of the price.
I've already put a deposit down 3 months ago but that's as assuming I would get the bike now, can't potentially wait 12 months.
has anyone had any experience with trek?

1st off, ask the store. If the answer is they keep 10%, call the ACCC.

Last year I ordered a Giant Roam 1. I was told in June that it should be here in mid to late July. In July I was told mid to late August. In August I was told early September, then mid-September. I eventually picked it up on 30/09/21. I was complaining and they did offer to refund my (only) $50 deposit, but I stuck it out. One of the problems I had was that when I ordered the 2021 models were a distant memory, so I was waiting for the 2022 model.
Things are unpredictable with supply chains currently, and especially where ships are involved. I don't know where you are, but I know that ships have been a real issue in Brisbane in the last month because of the floods - Port of Brisbane was limiting ships in the river/channel due to debris etc, so there was a lot of ships delayed and some just left to go to the next port.
I would be surprised if anyone will or could tell you with much accuracy how much longer you will wait. I would guess that a delay of 1-3 months could easily be a "supply chain" delay, but a (unexpected) delay of 12-13 months is just BS. I would think that right now would be still within the 2022 model manufacture year but I may be wrong.

My impression would be a 10% deposit would be conditional to the goods being delivered within the quoted timeframe.

there was no contract, but on the lay-by invoice it says...
"All canceled laybys will incur a restocking fee of 10% of the value of the full purchase if the layby is canceled four (4) weeks after a layby is
established. If the item is a special order for an unstocked item then there will be no waiting period once the order is confirmed incurring a 10% of the full value of the product if the order is canceled."
